Medical Malpractice: 5 Things You Need To Know

Did you know that in 2012, over $3 billion of medical malpractice payouts were spent in the US alone? Medical malpractice incidents are happening every minute anywhere in the world. It is considered as the third leading cause of death in the US (next to heart disease and cancer). So, if a patient is not aware of the medical negligence of his/her doctor, then chances are, someone’s life is in great danger.

What is Medical Malpractice?

When a person who has undergone some medical treatments but got harmed or hurt because his/her doctor failed to address proper health care treatment, or perhaps that person had a false diagnosis of his/her illness, then the patient might have experienced a medical malpractice. However, you can’t just say automatically that one has experienced one.

Before you can claim that there was a medical malpractice, there are some basic requirements to remember to prove that you have received a medical negligence. Here are some of the things you might consider before heading straight to any medical malpractice lawyer and probably file a complaint:

There is a doctor-patient relationship. You must prove that a doctor-patient relationship existed before suing a physician for his/her medical malpractice. This could only mean one thing: that you hired that doctor to treat/diagnose you and that the doctor agreed to treat/diagnose you as well.

The doctor must be negligent. A physician is liable for a medical malpractice if he/she is not skillful and careful enough in giving you treatment/diagnosis that his/her skills has already caused you harm. This could only mean that your doctor is NOT competent enough as compared to others who could have treat/diagnose you well.

The doctor’s negligence resulted to injury. A “harm” in a medical malpractice could be anything from surgical errors, wrong diagnoses, delayed treatment, failure to warn a patient of the risks or side effects of an operation, or even death. However, a patient (or someone from the patient’s family if the patient has died) must prove that it was the doctor’s incompetence that directly caused the “harm” or injury to him/her. It must be done by getting another medical expert to testify the other doctor’s negligence was the cause of the injury or death (and not the fatal disease).

The doctor is treating you in an unacceptable standard. You must prove that your attending physician was acting or treating you in a different way from the generally accepted standard way of treating/diagnosing a patient. If it finds you “weird” for a doctor to treat you in a way he/she shouldn’t have, then it might be considered as a medical negligence.

Your injury leads to damages. Here’s the thing: you can’t sue a doctor to a medical malpractice case unless he/she has done damage or certain damages to you. These damages may be physical and mental pains, loss of life’s pleasure, loss of work and earning capacity in the future, large amount of medical expenses and future medical bills, and/or punitive (intended) damage to a patient. However, damage may likely occur even without negligence, for instance, the patient dies from final stage of cancer. But if the family members of the patient insisted there was indeed negligence on the part of the doctor, then they can go to a medical malpractice lawyer and pursue the case.

Different countries or states have different take on medical malpractice cases. Always remember that you have the right to receive proper medical attention and services from medical professionals. Negligence from doctors is not an excuse because when it comes to receiving medical assistance every one of us is equal.

While I was waiting for the rain to stop during a mall stroll, I accidentally bumped into this store down at the lower ground of SM North Edsa. Called the Islands Souvenirs, I immediately got interested on the displays the store has to offer— t-shirts, ballers, t-shirts, bags, and more t-shirts galore!

The Islands Souvenirs is more of a store that sells t-shirt souvenirs when you are in or happens to visit Manila rather than a souvenir shop for tourists visiting Manila or other provinces. SM Department store's Kultura could have been a better choice for a souvenir shop rather than the Islands Souvenirs. However, if you are into looking for a t-shirt souvenir of your tour in Manila (for foreigners and balik-bayans), the Islands Souvenirs store is just the right t-shirt store for you!

When Cutting Your Hair Gives You Freedom!

A few weeks ago, I had a dilemma that most people with long, thick, curly hair experience — hair tangles! As you can see from the photo above, my hair was a little similar to that of Albert Einstein's. Whenever I wear that kind of hair, my friends would always say that I looked like the world renowned scientist, but only the hair resemblance. However, I would always say to them, "nah!", because I would rather not wanted to be compared.

My hair is a slow-grower. It took me one year and three months to achieve that very thick, curly hair. And oh, did I say it's really heavy on the neck to carry such a fluffy stuff on my head. So, when I decided to cut it short, as in super short, I am semi-bald (semi-kalbo, as what it is more popularly known), my friends from the office thought that I am mending a broken heart or that I am currently experiencing depression due to some love affairs that didn't work out for me. My answer is a big NO! It's just that, these past few days, the weather was really weird and was really extremely hot, I cannot carry my hair with poise anymore without making myself wet with waterfalls of sweat!

The Real Reason


So, why did I "really" cut my hair? The answer I think would rely on that famous quote by Belgicia Howell, "Never explain yourself. Your friends don't need it and your enemies won't believe it."

It was really a matter of choice. Before I cut my long, thick, curly hair, I was experiencing aching problems around my neck, developing itch behind my ears, and pimples starting to come out of my face pores. If you still don't know, your hair is one of the dirtiest part of your body because it collects all the dusts and particles in the air. When strands of hair are brushed or rubbed against your face skin, pimples might start to develop.This is the part where I can't control my hair to move away from my face, that's why pimples started to develop.

When I made a promise to my officemate friends who will become married couple in December, I promised to them that I will wear a braided hair (similar on the right, yes that's me!) on their wedding day. However, when I started feeling kinda 'sick' with my thick, curly hair, I said to myself that I will cut my hair soon. And so I started to wonder if growing my hair more would be worth it.

A Visit to the Barber


Not long after that, I find myself sitting on top of a barber's chair. The barber awed himself in a biggest shock of his life! Maybe, he was wondering why the hell am I going to let him cut or in this context, to shave my long, thick, curly hair, which I grew for more than a year? Before the cutting session started, he told me if I really wanted this to happen. And then I said, "yes!" with confidence. He just thought the years of growing my hair was just a waste of time. At first, he didn't want to cut (shave) it, but then, he shaved my hair with his eyes closed during the first shave. I was relieved. I think he was, too!

Twenty minutes later, I lost 5 pounds of hair. Hahaha! My neck and head are lighter and I can finally feel the aerodynamics flowing on top of my head! I can feel the freedom of moving my head again with ease without straining my neck. See the photo above!

Lessons Learned


I did not really learn something from just cutting my hair but I know I can now save a sachet of shampoo (the twin pack ones) from being used by me. I am now sporting a very short hair, similar to that of Derek Ramsay (pictured below), a local artist in the Philippines, but only the hair, and not the body. Hahaha! Now only if I can find where that Century Corned Tuna is!

Brisk Walking for Good Health!


We all know that walking is good for our body. It keeps our heart healthy and can maintain your body weight better. But if we are trying to lose weight just by walking for hours, why not a try a different alternative but the joy of walking is still there!

It's called brisk walking! I've been practicing brisk walking for a several months now and I can say that it really helps me sweat out more than traditional walking. Medical professionals and experts say, brisk walking helps fight against stress, improve heart rate and blood circulation and can burn more calories than that of traditional walking. Below is a news report on how we can practice brisk walking and its benefits.


So all you have to do to maintain a certain body weight OR to lose weight is to take 100 brisk walk per minute for only 30 minutes. It will not only cut off the time of traditional treadmill walking, but it will give us the same results or even surpassed what it can give you.

Now, here some simple tips when I'm doing the brisk walk:
• I do brisk walk in a very large area, say a brisk walk inside a mall, or in a community walk way. The larger area, the better.

• I sing some songs when I do brisk walk. This is to circulate the air that I am using while brisk walking. The faster the beat of the song, the better.

• I brisk walk with large steps. I love doing that. Hehehe.

• And finally, I drink a lot of water after a very short but hard brisk walk. This is to replace all the fluids that I loss through sweat.
